How does the law help me?
Under the California Lemon Law, you are entitled to receive a motorcycle buy-back or replacement if the following guidelines are met:
- Your Motorcycle was sold with a written warranty.
- Your Motorcycle was purchased or leased primarily for personal use.
- Your Motorcycle has had more than a reasonable number of repair attempts.
- Your Motorcycle has been in the repair shop for a cumulative total of 30 days since delivery.
- You became aware of your Motorcycle’s problems within 18 months of lease or purchase, or within 18,000 miles.
- Your Motorcycle has been subject to warranty repairs four (4) or more times by the manufacturer or dealer.
Like automobiles, your motorcycle may either be replaced or reimbursed; however, the only difference is the manufacturer will have the option to decide which of the two options to grant you. For instance, in a lemon car case, you would have the option to decline a replacement and choose a refund instead.

- Inform the manufacturer or dealer as soon as you realize there’s an issue with your motorcycle and include every detail possible. Pay close attention to the Repair Order - the defect must be completely noted on this document during repair(s).
- Keep notes of all details and conversations regarding your motorcycle’s malfunction or defect. Include times, dates, and names, if possible.
- Keep track of your mileage. Your motorcycle can be reported as a lemon if it falls within the 18,000 mile or 18-month time limit; whichever comes first.
